1 Agreement to Terms
Welcome to Gifted! These Terms of Service ("Terms") govern your access to and use of the Gifted platform, including our website, mobile applications, and related services (collectively, the "Service").
By accessing or using Gifted, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.
By using our Service, you acknowledge that you are entering into a legally binding agreement with Gifted.
2 Service Description
Gifted is a wishlist creation and gift registry platform that enables users to:
- Create Wishlists: Curate and organize items from any online retailer into personalized wishlists
- Share Wishlists: Share your wishlist publicly with friends, family, and followers
- Receive Gifts: Allow supporters to purchase items directly for you through our secure payment system
- Send Gifts: Browse and purchase wishlist items as gifts for others
How Gift Purchases Work
When someone purchases a gift through Gifted:
- The buyer selects an item from a wishlist and completes payment through our secure checkout
- Gifted processes the payment and notifies the wishlist owner of the gift
- The wishlist owner receives funds or the item is purchased on their behalf (depending on the item type)
- Transaction confirmations are sent to both parties via email
Note: Gifted is a platform facilitating gift transactions between users. We are not a retailer and do not sell physical products directly. Items displayed on wishlists are sourced from third-party retailers.
3 Payments & Transactions
Payment Processing
All payments on Gifted are processed securely through Square, Inc., a PCI-DSS Level 1 certified payment processor. When you make a purchase, your payment information is transmitted directly to Square and is never stored on Gifted servers.
Transaction Fees
Gifted may charge a service fee on transactions to cover payment processing and platform maintenance. All fees are clearly displayed before you complete any purchase.
Currency
All transactions are processed in US Dollars (USD). International users are responsible for any currency conversion fees charged by their financial institution.
Authorization
By making a purchase on Gifted, you authorize us to charge your selected payment method for the total amount displayed at checkout, including any applicable taxes and fees.
Failed Transactions
If a transaction fails for any reason (insufficient funds, card declined, etc.), the purchase will not be completed and no charges will be applied. You will be notified of the failure and may attempt the transaction again with a different payment method.
4 User Accounts
Account Creation
To use certain features of Gifted, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
Age Requirements
You must be at least 18 years old to create an account and use Gifted. By creating an account, you represent and warrant that you meet this age requirement.
Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our discretion. You may also delete your account at any time through your account settings.
5 User Conduct & Prohibited Activities
You agree to use Gifted only for lawful purposes and in accordance with these Terms. You agree NOT to:
Prohibited Items
- List or promote illegal items, controlled substances, or drug paraphernalia
- List weapons, ammunition, or explosives
- List adult content, pornography, or sexually explicit material
- List counterfeit goods or items infringing on intellectual property rights
- List items promoting hate, violence, or discrimination
- List gambling or lottery-related items
Prohibited Activities
- Use the Service for money laundering or fraudulent purposes
- Create fake accounts or impersonate others
- Harass, abuse, or harm other users
- Attempt to manipulate or game the platform
- Use automated systems (bots, scrapers) without permission
- Interfere with or disrupt the Service or servers
- Violate any applicable laws or regulations
Zero Tolerance Policy: Violations of these prohibited activities may result in immediate account termination, forfeiture of funds, and reporting to law enforcement where appropriate.
6 User Content & Intellectual Property
Your Content
You retain ownership of content you create on Gifted (profile information, wishlist descriptions, etc.). By posting content, you grant Gifted a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting the Service.
Content Responsibilities
You are solely responsible for the content you post. You represent that you have all necessary rights to post such content and that it does not violate any third-party rights.
Gifted's Intellectual Property
The Gifted name, logo, and all related trademarks, service marks, and intellectual property are owned by Gifted. You may not use our intellectual property without prior written consent.
Third-Party Content
Product images and descriptions from third-party retailers are the property of their respective owners. Gifted displays this content for informational purposes and makes no claim to ownership.
7 Disputes & Resolution
Transaction Disputes
If you have a dispute regarding a transaction, please contact us within 30 days of the transaction date. We will work with both parties to resolve the issue fairly.
Dispute Resolution Process
- Contact Support: Email support@meetpe.io with your transaction details
- Investigation: We will review the dispute within 5 business days
- Resolution: We will communicate our decision and any applicable remedies
- Appeal: If you disagree with our decision, you may request a review
Chargebacks
We encourage you to contact us before initiating a chargeback with your bank. Excessive chargebacks may result in account suspension. See our Refund Policy for more information.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
8 Disclaimers & Limitation of Liability
Service Availability
Gifted is provided "as is" and "as available." We do not guarantee uninterrupted, secure, or error-free service. We may modify, suspend, or discontinue the Service at any time without notice.
Third-Party Products
We are not responsible for the quality, accuracy, or availability of products listed on wishlists. Product information comes from third-party retailers and may change without notice.
Limitation of Liability
To the maximum extent permitted by law, Gifted and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.
Indemnification
You agree to indemnify and hold harmless Gifted, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
9 Changes & Contact Information
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
